1. Acceptance of Terms
By accessing, browsing, or using KongPaper ("the Service," "Platform," or "Website"), you ("User," "You," or "Your") accept and agree to be bound by these Terms and Conditions ("Terms," "Agreement," or "T&C"), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.
If you do not agree with any of these Terms, you are prohibited from using or accessing this Platform. The Service is operated by ThinkThinkSyn Limited (先循有限公司), a company duly registered under the laws of the Hong Kong Special Administrative Region (HKSAR).

These Terms constitute a legally binding agreement. By clicking "I Agree," creating an account, or using the Service in any manner, you signify your acceptance of these Terms.
2. Eligibility and Registration
2.1 Age Requirements & Parental Consent
KongPaper is accessible to students of all ages. By using the Service, you agree:
- Adults (18+): You have full legal capacity to enter this Agreement.
- Minors (Under 18): You must have parental/guardian consent. The parent/guardian is legally responsible for all actions taken under the account.
- Schools: Educational institutions using the Service represent they have obtained necessary PDPO consents for their students.
Note: KongPaper reserves the right to request proof of parental consent or school authorization at any time. Accounts found to be in violation may be suspended.
2.2 Account Creation and Security
You are strictly liable for all activity on your account. KongPaper is not responsible for any loss resulting from unauthorized access to your account. We reserve the right to refuse registration or cancel accounts at our sole discretion.
You should provide accurate information during registration. You are solely responsible for:
- Maintaining the confidentiality of your account credentials;
- All activities occurring under your account, including those by minors under your supervision;
- Notifying us immediately at [email protected] of any unauthorized account use.
2.3 Account Sharing Prohibition
Multiple students sharing one account is strictly prohibited. The Service is licensed for individual use only. Any detection of account sharing (e.g., simultaneous logins from multiple locations) will result in immediate suspension or termination without refund.
3. Intellectual Property Rights
3.1 Platform Intellectual Property
The AI models, machine learning algorithms, proprietary prompt engineering techniques, software source code, user interface design, database architecture, and all associated intellectual property are the exclusive property of ThinkThinkSyn Limited and are protected by:
- Hong Kong Copyright Ordinance (Cap. 528) and international copyright treaties;
- Trade Secrets Ordinance and confidentiality laws;
- Trademark laws (pending registration: "KongPaper" and associated logos);
- Patent laws where applicable.
3.2 User Input Warranty
You represent and warrant that you own or have the necessary licenses to the content (prompts/files) you upload. You agree to not upload content that infringes any third-party intellectual property. By uploading, you grant us a perpetual license to use such data to train and improve our AI models.
3.3 AI-Generated Output Content
The educational materials, exam papers, essay feedback, and other content generated by the AI ("Output Content") are subject to the following license terms:
Limited Educational License
We grant you a non-exclusive, non-transferable, revocable license to use AI-generated Output Content for:
- Personal educational purposes;
- Classroom distribution to students (if you are an educator);
- Printing for home or school use.
Prohibited Uses of Output Content:
- Commercial resale or redistribution of AI-generated papers;
- Uploading to public "cheat sites," academic fraud databases, or homework-sharing platforms (e.g., Chegg, Course Hero);
- Using Output Content to train competing AI systems or create derivative AI products;
- Claiming authorship or ownership of AI-generated content.
4. Acceptable Use Policy
You agree to use the Service in a lawful and responsible manner. The following activities are strictly prohibited:
4.1 Prohibited Activities
- Privacy Violations: Inputting Personally Identifiable Information (PII) of third parties (e.g., real names, HKID numbers, addresses, phone numbers) into AI prompts without explicit consent;
- AI System Abuse: Engaging in "Prompt Injection," "Jailbreaking," or other techniques designed to bypass safety filters, extract system prompts, or manipulate the AI to produce harmful or off-policy content;
- Security Threats: Attempting to hack, reverse-engineer, decompile, or extract the source code of the Platform;
- Network Attacks: Launching denial-of-service (DoS/DDoS) attacks, SQL injection, cross-site scripting (XSS), or other cyber attacks;
- Automated Abuse: Using bots, scrapers, or automated scripts to access the Service without prior written authorization;
- Content Policy Violations: Generating or attempting to generate content that is:
- Politically sensitive or violates the National Security Law of the HKSAR;
- Defamatory, obscene, pornographic, or hateful;
- Promoting violence, terrorism, or illegal activities;
- Infringing on the intellectual property rights of others.
4.2 Enforcement and Consequences
Violations of this Acceptable Use Policy may result in:
- Immediate account suspension or termination without prior notice;
- Forfeiture of all prepaid fees without refund;
- Legal action, including reporting to Hong Kong Police Force (HKPF) Cyber Security and Technology Crime Bureau (CSTCB) or other relevant authorities;
- Claims for damages, injunctive relief, or other legal remedies.
5. AI-Generated Content Disclaimer ("AI Accuracy Clause")
⚠️ CRITICAL DISCLAIMER - PLEASE READ CAREFULLY
KongPaper utilizes advanced artificial intelligence and machine learning systems to generate educational content, exam papers, and feedback. While we employ state-of-the-art technology and conduct rigorous quality assurance, AI systems are not infallible.
Known AI Limitations:
- Hallucinations: The AI may generate factually incorrect information, fabricated references, or nonsensical content that appears plausible;
- Contextual Misunderstanding: The AI may misinterpret nuanced prompts or cultural references specific to Hong Kong's DSE/IELTS curriculum;
- Inconsistent Marking: Essay grading may vary in strictness or interpretation compared to human examiners;
- Outdated Information: AI training data may not reflect the most recent curriculum changes or examination board guidelines.
5.1 No Warranty of Accuracy
KongPaper makes no warranty, representation, or guarantee that AI-generated content is:
- Factually accurate or aligned with official curricula;
- Suitable for high-stakes examination preparation without human review;
- Free from errors, omissions, or misleading information;
- Predictive of actual examination results or academic performance.
5.2 User Responsibility
The Platform is a supplementary educational tool only. Users are strongly advised to:
- Cross-reference AI-generated content with official textbooks, past papers, and teacher guidance;
- Seek professional educational advice from qualified tutors or educators for critical examination preparation;
- Treat AI feedback as one input among many, not as definitive or authoritative assessment.
5.3 Limitation of Liability for AI Errors
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KONGPAPER SHALL NOT BE LIABLE FOR:
- Any academic grades, examination results, or university admissions outcomes negatively affected by reliance on AI-generated content;
- Psychological distress, reputational harm, or educational setbacks arising from inaccurate AI feedback;
- Loss of study time, opportunity costs, or consequential damages related to AI errors.
Our aggregate liability for all claims related to AI accuracy shall not exceed the lesser of: (a) HK$1,000, or (b) the total fees you paid to KongPaper in the six (6) months preceding the claim.
6. Payment Terms and Subscription
6.1 Accepted Payment Methods
All payments are processed in Hong Kong Dollars (HKD). We accept:
- Major credit cards (Visa, Mastercard, American Express);
- Faster Payment System (FPS);
- Octopus Online Payment (where available);
- PayPal and other approved digital wallets.
6.2 Subscription Auto-Renewal
Subscriptions (monthly or annual) automatically renew at the end of each billing cycle unless you cancel before the renewal date. By subscribing, you authorize KongPaper to charge your payment method automatically.
We will send a renewal reminder email at least 7 days before the renewal date. Failure to receive this email does not waive the renewal obligation.
6.3 Price Changes
We reserve the right to modify subscription pricing at any time. Existing subscribers will receive 30 days' advance notice of price increases. The new pricing will apply starting from the next billing cycle.
6.4 Taxes
All prices are exclusive of applicable taxes, duties, or government charges (including but not limited to VAT, GST, or sales tax). You are responsible for paying all such taxes.
6.4 Service Modifications
We reserve the right to modify or discontinue any feature of the Service at any time without notice or liability to you.
7. Data Protection and Privacy
Your use of the Service is governed by our comprehensive Privacy Policy, which is incorporated into these Terms by reference. We are committed to compliance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong.
Key data practices include:
- Collection of Identity, Contact, Academic, and Behavioral Data (see Privacy Policy Section 1.1);
- Use of anonymized data for AI training and algorithm optimization;
- Cross-border data transfers to AI infrastructure providers (e.g., Microsoft Azure, AWS) with appropriate safeguards;
- Retention of data for the account lifetime plus 7 years for legal/tax compliance.

8. Indemnification
You agree to indemnify, defend, and hold harmless ThinkThinkSyn Limited, its directors, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including legal fees) arising from:
- Your use of and access to the Service;
- Your violation of any term of these Terms;
- Your violation of any third-party right, including copyright or privacy rights;
- Any claim that your User Content caused damage to a third party.
9. Limitation of Liability
READ THIS SECTION CAREFULLY. IT LIMITS OUR LIABILITY TO YOU.
- Statutory Exceptions: Nothing in these Terms shall limit our liability for death or personal injury caused by our negligence, or for fraud, where such limitation is prohibited by the Control of Exemption Clauses Ordinance (Cap. 71).
- General Cap: For all other matters, our total aggregate liability shall not exceed HK$1,000 or the total amount paid by you in the last 6 months, whichever is lower.
- AI Specific: We are not liable for "AI Hallucinations," incorrect exam answers, or any academic failure resulting from the use of our Output Content.
- No Indirect or Consequential Damages: KongPaper and ThinkThinkSyn Limited shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:
- Loss of profits, revenue, or business opportunities;
- Loss of data, goodwill, or reputation;
- Cost of procurement of substitute services;
- Academic or career-related losses (failed exams, university rejections, etc.).
- Financial Cap: Our total aggregate liability for all claims arising from or related to these Terms or the Service shall not exceed the lesser of: (a) HK$1,000, or (b) the total amount you paid to KongPaper in the six (6) months immediately preceding the claim.
- Force Majeure: We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including acts of God, war, terrorism, civil unrest, labor disputes, pandemic, government actions, internet outages, or third-party service failures.
Some jurisdictions do not allow the limitation of liability for certain damages. In such cases, our liability is limited to the fullest extent permitted by applicable law.
10. Disclaimer of Warranties
"AS IS" AND "AS AVAILABLE" BASIS
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability;
- Fitness for a particular purpose;
- Non-infringement;
- Quiet enjoyment;
- Accuracy, reliability, or quality of any content, information, or service.
KongPaper does not warrant that:
- The Service will be uninterrupted, secure, or error-free;
- Defects or bugs will be corrected within any specific timeframe;
- The Platform will meet your specific educational requirements or expectations;
- AI-generated content will be accurate, complete, or suitable for your purposes.
11. Termination
11.1 Termination by KongPaper
We reserve the right to suspend, disable, or terminate your account and access to the Service, with or without notice, for any reason, including but not limited to:
- Violation of these Terms or any applicable laws;
- Conduct harmful to other users, KongPaper, or third parties;
- Suspected fraudulent activity or payment disputes;
- Extended periods of inactivity (24+ months);
- Operational or business reasons (e.g., discontinuation of the Service).
11.2 Termination by User
You may terminate your account at any time by contacting [email protected] or using the account deletion feature in your settings. Termination does not entitle you to a refund of prepaid fees unless otherwise specified in our Refund Policy.
11.3 Effect of Termination
Upon termination:
- Your right to access and use the Service immediately ceases;
- We may delete your account data after a 30-day grace period (except as required for legal/tax retention);
- All licenses granted to you under these Terms are revoked;
- Sections that by their nature should survive (e.g., IP rights, indemnification, limitation of liability) remain in effect.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law provisions.
12.2 Jurisdiction
Any disputes, claims, or controversies arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Hong Kong. You irrevocably submit to the jurisdiction of such courts and waive any objection to venue.
12.3 Dispute Resolution (Optional Mediation)
Before initiating formal litigation, parties are encouraged (but not required) to attempt resolution through mediation via the Hong Kong Mediation Centre or another mutually agreed mediator.
13. Miscellaneous Provisions
13.1 Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and KongPaper regarding the Service and supersede all prior agreements, understandings, or representations.
13.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to reflect the parties' intention to the maximum extent permitted by law, or if incapable of modification, severed from these Terms. The remaining provisions shall remain in full force and effect.
13.3 Waiver
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. KongPaper's failure to enforce any right or provision shall not constitute a waiver of such right or provision.
13.4 Assignment
You may not assign or transfer these Terms or your account without our prior written consent. KongPaper may assign these Terms to any affiliate or successor entity without restriction.
13.5 Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Material changes will be notified via email or in-platform notification at least 14 days before taking effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
